Liability waiver

Please read this Agreement carefully. By signing below, you — the parent or legal guardian ("Parent") — are agreeing on behalf of yourself and your child ("Player") to the terms of participation in Idaho Stags Basketball ("Idaho Stags" or "the Club") tryouts, and, if the Player is offered and accepts a roster spot, in Club activities for the season.

1. Tryouts & Team Placement

  1. Registering and paying the tryout fee reserves the Player's spot at tryouts only. Trying out does not guarantee a roster spot. Team placements are offered separately after tryouts, and each offer has its own acceptance steps and deadline.
  2. The Club places players based on evaluation, readiness, and team needs. Placement decisions are final.

2. Fees & Refund Policy

  1. The tryout fee is non-refundable, including if the Player does not attend, is not offered a roster spot, or declines an offer.
  2. If the Player accepts a roster spot: player dues (including any installment payments) and AAU membership fees are non-refundable, including if the Player later withdraws, is dismissed under Section 7, or misses practices, games, or tournaments for any reason.
  3. Payment plans, when offered, are a convenience only — accepting a roster spot is a commitment to the full season dues.

3. AAU Membership Requirement

If the Player is offered and accepts a roster spot, the Player must hold a current AAU Youth Athlete Membership before attending any team practice. Instructions for purchasing the membership are provided with the placement offer. Players without an active AAU membership may not practice or compete until it is in place.

4. Health Certification & Medical Authorization

  1. Parent certifies that the Player is in good health and physically able to participate in basketball training, tryouts, practices, games, and tournaments, and that Parent has disclosed to the Club any medical condition that could affect safe participation.
  2. In an emergency, if Parent cannot be reached, Parent authorizes Club staff to secure medical treatment for the Player, at Parent's expense.

5. Assumption of Risk

Basketball and athletic training involve significant risks and hazards, including serious injury, sickness, permanent disability, and death, which may result from the Player's own actions, the actions of other participants, the conditions of facilities, or the negligence of others. Parent understands these risks and voluntarily assumes full responsibility for any injury, illness, or death that may result from the Player's participation in Club tryouts, events, and activities ("Activities").

6. Release, Waiver & Indemnification

  1. Release. To the fullest extent permitted by law, Parent — on behalf of Parent, the Player, and their heirs, representatives, executors, assignees, and transferees — releases and holds harmless Idaho Stags; its owners, directors, coaches, assistants, staff, and volunteers; Ricky Bower; Mettle Sports; and the schools, districts, and facility owners that host Activities (including the Nampa School District, Skyview High School, Legacy Charter School, and NNU) (together, the "Released Parties") from any and all liability, claims, demands, actions, or rights of action related to, arising out of, or in any way connected with the Player's participation in Activities, including those allegedly attributable to the negligent acts or omissions of any Released Party.
  2. Financial responsibility. Parent accepts full financial responsibility for any injury or damage that the Parent or Player causes to any Released Party or to facilities or equipment through negligence, misuse, or intentional acts.
  3. Indemnification. Parent agrees to indemnify and hold harmless the Released Parties from liability for injury, death, or damage resulting from the Parent's or Player's negligent or intentional acts or omissions during Activities.
  4. Enforcement costs. If a Released Party incurs attorney's fees or costs enforcing this Agreement, Parent agrees to reimburse those fees and costs.

7. Conduct, Facilities & Dismissal

  1. We are guests in the schools and gyms that host us. Players, parents, and family members must treat all facilities, equipment, and staff with respect. Damage may result in financial responsibility and loss of participation.
  2. The gym is a classroom. Players must stay focused during practices and events. Disruptive behavior — by players, siblings, or parents — is not permitted.
  3. Sportsmanship. Players and parents must uphold high standards of sportsmanship, respect, and integrity at all Club events, toward teammates, opponents, officials, and coaches.
  4. The Club reserves the right to dismiss any Player whose conduct — or whose family's conduct — is a persistent distraction or violates this Agreement, without refund of any fees or dues.

8. Player Development & Playing Time

The Club's goal is to develop each Player as an athlete and a person. Every Player is a valued team member, but roles differ: equal playing time is not guaranteed and likely will not occur. Playing time is based on readiness, effort, and game understanding. Every Player is expected to give best effort, keep a great attitude, and be a good teammate.

9. Season Commitment & Exclusivity

Accepting a roster spot is a full-season commitment. Playing for another club program during the season requires prior approval from the Club director.

10. Talent, Photo & Media Release

  1. Parent grants Idaho Stags and its authorized service providers (including the platform hosting the Club's web and registration pages) an irrevocable, royalty-free permission to photograph, film, and record the Player at Activities, and to use, reproduce, edit, publish, and display the Player's image, likeness, name, jersey number, and voice, in whole or in part, in any media now known or later developed — including the Club's website and registration pages, team pages, printed materials, and social media — for Club promotional, informational, and archival purposes, without compensation, notice, or further approval.
  2. Parent waives any right to inspect or approve the finished materials and releases the Club and its service providers from claims arising from such use, including claims of misappropriation of likeness, defamation, or invasion of privacy, except for uses prohibited by law.
  3. This release does not permit the sale of the Player's likeness for purposes unrelated to the Club.
  4. To decline this release, contact Team@IdahoStags.com in writing before the Player's first Activity; declining does not affect tryout or team participation.

11. Communications

Parent consents to receive Club communications (registration confirmations, schedules, team and payment notices) by email and text at the contact information provided during registration.

12. General Terms

  1. This Agreement is governed by the laws of the State of Idaho.
  2. If any provision is held unenforceable, the remaining provisions remain in full force.
  3. This Agreement, together with the registration details and any placement offer the Parent accepts, is the entire agreement regarding participation, and is binding on the Parent's and Player's successors, representatives, heirs, executors, assignees, and transferees.
  4. Electronic signature. Parent agrees that checking the agreement box and typing their name during registration constitutes a legal electronic signature with the same effect as a handwritten signature.
